A Notice & Takedown, what is the procedure?

As a hosting provider, we offer you as a customer the opportunity to publish content on the internet, such as texts, videos, and images. We have no direct influence on the content you publish as a customer. 

As a result, it can happen that undesirable content is published that violates Dutch laws and regulations. If this is the case, you can contact the party that has the most influence over the removal of the content. 

What is the order of most influence?

It starts with the person or organization that published the content; often there is a contact form or email address available to get in touch. The next in line to contact is the domain name holder, which is often the same person or organization managing the website. After that comes us as the hosting provider. If you have not received a response or a hearing for your request, you can submit a report to us. We will then also inform the people and/or organization involved.

The final option is to inform the registrar of the domain name.

The procedure

As explained above, you must first contact the person or organization. If you receive no response from them, you can submit a report (Notice) to us as the hosting provider to execute a Notice & Takedown procedure.

We can best execute this procedure if you ensure that your report contains as much information as possible. Think of URLs where the content is located, but also IP address(es). It is also important that you state why this content should not be published. This is because it is not always self-evident that the content is harmful. For example, with explicit material, it is often easier to establish that it is harmful than, for example, a blog or article containing misinformation. 

Finally, we ask you to provide information about all the efforts made and attempts to contact the relevant person, organization, or domain holder who published the content. If any responses came from these attempts, we would like to receive those as well.

 

What happens next?

After receiving the request, we will immediately take action and contact our customer. We will then ask for a response to the reporter's request. In doing so, we give our customer an appropriate timeframe to respond. This depends on the severity of the content, but it is a maximum of 1 week.

After our customer's response, we will look at the next step in the Notice & Takedown procedure. We will investigate whether there is actually harmful content. If so, we will make access to the content impossible for our customer. Afterwards, we will inform both you as the reporter and our customer of our findings and actions.
